Obtaining Austrian citizenship by descent is based on Sec. 58c of the Austrian Nationality Act (Austrian citizenship by declaration):
All former Austrian citizens who were forced to leave Austria before May 9, 1945 because they had to fear or suffered persecution by the NSDAP and/or the authorities of the Third Reich or they had to fear or suffered persecution because of defending the democratic Republic of Austria may re-acquire their Austrian citizenship by declaration.
The applicants are exempt from payment of state fees and do not require to reside in Austria, to have knowledge of German or to renounce their present citizenship.
An amendment to the Austrian Nationality Act, adopted in 1999, makes it possible for those who hold citizenship of successor states of the Austro-Hungarian Empire to obtain Austrian citizenship as well.
In situation when the applicant does not have documents which clearly proves the aforementioned criteria (that his/her ancestors hold Austrian citizenship and had to leave Austria) an archival research may be required.
